The filing of the Original Petition for Divorce legally begins the divorce process. It is the document that asks the Court to legally dissolve your marriage. This document will be served on your spouse to tell him/her they are being divorced regardless of whether or not they want to be.
If your divorce is uncontested, your spouse may be willing to waive service to save the cost and embarrassment of having a private process server go to their office or home and physically hand them a copy of the petition and citation. These and other matters involving divorce will be discussed in your initial interview with the attorney.

The Procedure of Divorce and Expectations:

The expectations people have during divorce is often unrealistic. Divorce is nothing more than the legal process of ending a marriage. Emotions are usually always high between couples during the divorce process and there is sometimes a desire to punish or get even with the other party. Couples need to be aware that the courts work in the legal capacity ONLY of simply ending the marraige. To expect judges or attorneys to punish your spouse for their bad behavior or to feel the same way you do is unrealistic.

Acting as Your Own Attorney:

We never recommend you acting as your own attorney, "Pro se," but especially do not recommend you doing so in divorce. While there are downloadable forms on the internet, these forms are generic and usually not state specific and are never specific to your individual situation. Typically judges and clerks frown on people representing themselves because you are expected
to know the correct legal procedures without their assistance. Family Law, perhaps more than any other legal practice, has far more personal consequences. We understand the emotional impact of these changes and work with you to move toward a resolution. Divorce is never a simple procedure and hiring an attorney that will represent you and look out for your best interests, and especially those of your children, is always recommended.
